Once the sole domain of software, the desktop is rapidly losing ground to the browser as web-based applications or “web apps” continue to gain popularity. Being accessible from anywhere that has an internet connection, and on a wide range of different devices and platforms, web apps offer a number of advantages over and above software installed on an individual device.

These Web App Terms and Conditions have been designed for use with free web apps (and may also be adapted for use with portions of premium web apps which may offer partial free functionality). The terms are sufficiently flexible and open to enable this template to be used with a broad variety of different types of web application.

Very similar to website terms and conditions, the provisions of this document establish the relationship between the operator of a web app and their users, governing users’ conduct and use of the service and addressing key areas such as intellectual property rights (and, most importantly, the retention by users of the IP rights in their user content), acceptable usage, legal rights, liability, privacy and data protection.

A consumer-friendly approach has been taken to the drafting of this template, aimed at making its terms understandable and accessible to consumers. It can also be used with business users, however, and where different provisions apply to business users and consumer users, this is made clear in the text.
